Another kritarch has struck again, ordering a lawless release of illegal aliens infected with the China Virus into Florida just as the unconstitutional lock-down is easing. Not surprisingly, the kritarch is a long-time beneficiary of affirmative action from Conservative, Inc. and the Bush family. Marcia Cooke has a long time association with establishment Republicans and has failed up her whole career based on being black. Now she will be endangering thousands of Americans by releasing illegal aliens to spread the Wuhan Virus back into Florida.

A Miami federal court judge has ordered U.S. Immigration and Customs Enforcement to release more than 1,200 undocumented immigrants detained in three South Florida detention centers.

As part of U.S. District Court Judge Marcia G. Cooke’s ruling, any person who has a non-violent criminal offense or underlying medical history will be eligible to be release under certain guidelines.

Detainees could be subjected to wearing electronic ankle bracelets, physical or phone check-ins and parole.

Prisoners at Krome Processing Center in Miami-Dade County, the Glades County Detention Center in Moore Haven and the Broward Transitional Center in Pompano Beach have continuously complained about their fears of contracting the coronavirus and the lack of preventive measures from ICE to contain the outbreak at the facilities.

‘There is recorded evidence demonstrating that ICE has failed in its duty to protect the safety and general well-being of the petitioners,’ Cooke wrote in her 12-page court ruling. ‘Social distancing at Krome is not only practically impossible, the conditions are becoming worse every day.’

Now there is nothing in the Constitution or Federal statute that states an immigration detention center must have room for social distancing. Detainees in immigration detention centers, prisoners in county jails, or convicted criminals in State and Federal prisons were until today never released because of diseases, much less for diseases that are the equivalent of the flu, which also kills tens of thousands of Americans each year, including detainees and inmates. In fact, this 2019-2020 flu season the Centers For Disease Control (CDC) estimate that 62,000 Americans will die of the flu. Never before have Americans been advised to stop work or social distance to avoid the flu, despite the fact that it kills a wider number of Americans than the Chinese Flu. Most deaths of the China Flu are old and seriously ill. No children are dying of the Wu Flu, but lots of old people living in care facilities.

So, there is no problem for Kritarch Cooke to solve. First, she has no legal authority to determine who is held in immigration custody, nor is there any legal authority for her to decide that non-violent criminals can be released along with sick illegal aliens, but allow violent illegal aliens to remain in “unhealthy conditions.”

Cooke is just exercising raw power, but she actually has no power to back up her illegal orders. As Alexander Hamilton said of the judiciary in Federalist 78, it has “…no influence over either the sword or the purse, …It may truly be said to have neither FORCE nor WILL, but merely judgment.” In practical terms, an order from a Federal judge is enforced by the United States Marshal and his deputies in a particular judicial district. The U.S. Marshal and his deputies are Executive Branch employees, and President Trump can order the U.S. Marshal for the Southern District of Florida, Donald Washington, to ignore any court order to enforce releasing the aliens and order the Field Office Director for U.S. Immigration and Customs Enforcement Enforcement and Removal Operations (ICE ERO) to not release the aliens.

Strangely, the U.S. Marshal for the Southern District of Florida is another black and he has no law enforcement background. Usually, U.S. Marshals, Presidential appointments, are drawn from the President’s law enforcement supporters, usually local sheriffs and police chiefs active in party politics. But Washington is a former U.S. Attorney from Louisiana. That’s even more unusual as the common practice is to use nominate a local, not a carpetbagger; similarly, Kritarch Cooke is also from out-of-state, hailing from Michigan, not Florida. Florida has plenty of Republican lawyers and sheriffs, but why are both from out-of-state? This is an insult to local Republican sheriffs and police chiefs. Perhaps more Deep State sabotage by Reince Priebus in the personnel area. Personnel is policy, another failing of the Trump Administration.
