Re: Today's Letter: A CA Reader Says Media Coverage Of Richmond High School Rape Requires "Barf Bags"

Letter writer Angie Saxon wrote that criminal lawyer Mary Carey is defending alleged rapist Jose Carlos Montano, one of the perpetrators in the Richmond High School rape of a young, white victim.

A private practice lawyer for a poor Hispanic kid? Someone outside Montano's family is no doubt footing the bill.

Although circumstances vary, private attorney retainer fees generally start at around$2,000-$4,000. In felony cases the retainers can be $5,000-$10,000, but could easily be $25,000-$50,000 or more for extremely serious charges, such as homicide or sexual assault.

Retainers are just the beginning. Montano's total legal bill will be much higher.

Since Montano attended a school that is and 78 percent Hispanic and eligible for Title 1 federal assistance, it is logical to conclude that his family cannot afford costly and protracted private legal defense.

Montano is innocent until proven guilty. But the obvious question is: who's paying for Montano's defense—and why?
